Crewman Terms of Service
Effective date: August 27, 2026
Last updated: August 27, 2026
These Terms of Service (the "Terms") are a binding agreement between you and Crewman ("Crewman," "we," "us," or "our") governing your access to and use of the Crewman mobile application, website, payment-facilitation features, and related services (collectively, the "Service").
Please read these Terms carefully. By creating an account, tapping an acceptance control that references these Terms, or accessing or using the Service, you agree to these Terms and acknowledge the Crewman Privacy Policy. If you do not agree, do not use the Service.
1. The Crewman Service
Crewman provides marketplace, discovery, communication, milestone-payment, reputation, and dispute-administration tools for automotive customization work, including window tint, paint-protection film, vinyl wrap, and ceramic coating.
The Service has two user roles:
- Shops are businesses that post projects and hire installers.
- Installers are independent tradespeople or businesses that apply for and perform projects.
A Shop and an Installer enter into a direct agreement for a project when the Installer accepts the Shop's hire offer (the "Project Agreement"). The Project Agreement includes the job description, location, schedule, accepted price, milestones, messages, and any other terms the parties confirm through the Service.
Crewman is not a party to the underlying Project Agreement, does not perform installation work, and does not employ Installers. Crewman may administer the Service's payment, safety, reputation, and dispute procedures, but it does not control the day-to-day manner in which a project is performed.
2. Eligibility and authority
You must be at least 18 years old, legally capable of entering a contract, and located in the United States to use the Service. By using the Service, you represent that you meet these requirements.
If you use Crewman for a company or other organization, you represent that you have authority to bind that organization, and "you" includes both you and the organization.
You may not use the Service if you are prohibited from doing so by law, have been permanently removed from Crewman, or are subject to sanctions that prohibit the relevant activity.
3. Accounts
You must provide accurate, current, and complete information and keep it updated. You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify Crewman promptly if you suspect unauthorized access.
Each account may hold one marketplace role during the pilot. You may not transfer, sell, rent, or share an account. You may not create an account using another person's identity or use multiple accounts to evade restrictions, manipulate reviews, or commit fraud.
Authentication is provided through Clerk. Additional terms from Clerk may apply to its services.
4. Profiles, verification, and user diligence
Crewman may review Shop information before allowing a Shop to post jobs. Approval means only that the Shop passed Crewman's limited platform review at that time. It is not an endorsement, background check, credit check, guarantee, license verification, insurance verification, or representation about the quality, legality, solvency, safety, or conduct of any user.
Installers may become visible without a background, license, skill, insurance, or identity investigation beyond the processes expressly shown in the Service. Optional insurance information is user-provided and may not be verified.
Users are responsible for conducting their own diligence before entering a Project Agreement, including checking identity, references, experience, licenses, permits, insurance, facilities, vehicle authorization, and any other matter relevant to the project.
5. Shop responsibilities
A Shop agrees to:
- post only genuine projects it is authorized to offer;
- provide accurate scope, vehicle, location, timing, pricing, access, and readiness information;
- disclose materials, conditions, hazards, customer requirements, and acceptance criteria reasonably relevant to the work;
- maintain a safe and lawful workplace and obtain necessary customer or vehicle-owner authorization;
- comply with employment, contractor-classification, wage, safety, tax, licensing, privacy, and consumer-protection laws applicable to the Shop;
- fund each required milestone before work begins;
- inspect submitted work and respond to submissions and adjustments in good faith; and
- pay all displayed charges and amounts it authorizes.
A Shop may not use Crewman to avoid legal obligations to a worker or misclassify a worker whose actual relationship is employment under applicable law.
6. Installer responsibilities
An Installer agrees to:
- apply only for work the Installer is qualified and legally permitted to perform;
- provide accurate profile, portfolio, availability, experience, insurance, and payout information;
- independently decide whether to apply for or accept a project;
- perform accepted work professionally, safely, lawfully, and according to the Project Agreement;
- supply the tools, personnel, licenses, permits, and insurance for which the Installer is responsible;
- promptly communicate delays, damage, scope conflicts, unsafe conditions, or inability to perform;
- protect vehicles, property, customer information, and confidential business information; and
- determine and pay the Installer's taxes and other legal obligations.
Installers operate independent businesses. Nothing in these Terms creates an employment, agency, partnership, franchise, or joint-venture relationship between Crewman and an Installer, authorizes an Installer to bind Crewman, or guarantees any minimum amount of work or income. The legal classification of a working relationship depends on the actual facts and applicable law, not only the label used in these Terms.
7. Jobs, applications, offers, and hiring
Only approved Shops may post jobs. Jobs may use fixed, hourly, or open pricing. An hourly listing does not include Crewman time tracking; the accepted offer and milestones must state the amount to be funded.
An Installer may submit an application and, where applicable, a proposed rate. Contact information may be revealed according to the Service's marketplace rules. A Shop may send a hire offer stating the total agreed amount. Unless the Service shows otherwise, a hire offer expires 72 hours after it is sent.
When the Installer accepts the offer:
- the Project Agreement becomes confirmed;
- the accepted amount and job terms become locked except through supported milestone, adjustment, cancellation, or dispute procedures;
- other applicants may be declined automatically; and
- an initial draft milestone may be created.
Users must review the complete job and payment terms before confirming. Crewman does not guarantee that a user will apply, hire, appear, perform, pay, or complete a project.
8. Communications and contact information
Crewman offers job-related text and photo messaging. Before hire, the Shop generally initiates messaging. After hire, the hired project thread becomes mutual. Threads for unsuccessful applicants may become read-only.
Messages are generally immutable and retained as a project paper trail. Do not place unnecessary sensitive information in a message or attachment. Crewman administrators may access relevant communications when a report, dispute, safety issue, support matter, legal requirement, or enforcement action justifies access. Certain administrative access is logged.
Crewman may reveal phone numbers and other contact information as part of applications, offers, and hiring. Once users communicate outside Crewman, those communications are outside Crewman's technical control. Users remain bound by these Terms when the communication relates to a Crewman-originated relationship.
9. Stripe and payment services
Crewman uses Stripe to process payments and provide connected payout accounts. Payment processing services for Installers are provided by Stripe and are subject to the Stripe Connected Account Agreement, which incorporates the applicable Stripe Services Agreement. By creating or using a connected payout account, you agree to the applicable Stripe agreements, as Stripe may modify them.
You agree to provide accurate and complete information to Crewman and Stripe and authorize Crewman to share account and transaction information with Stripe as necessary to provide payment and payout services. Stripe may require identity, business, bank, and tax information and may suspend or restrict a connected account.
A. Funding authorization
When a Shop funds a milestone, the Shop authorizes Stripe to charge the total displayed before confirmation. The displayed total may include the milestone amount, payment-processing costs, taxes, and any clearly disclosed Crewman fee. Crewman's platform fee is zero as of the effective date of these Terms, but payment-processing costs may be added to the Shop's total. Any future Crewman fee will be disclosed before the Shop authorizes the transaction.
Available payment methods depend on Stripe, the user's account, location, and current configuration. Crewman does not guarantee that a particular card, bank-transfer, or other payment method will be available.
B. How milestone funds move
Crewman uses Stripe Connect separate charges and transfers. A funded payment is charged through Crewman's Stripe platform account. After the applicable release conditions are met, Crewman instructs Stripe to transfer the release amount to the Installer's connected Stripe account and, when applicable, refund part of the payment to the Shop.
The words "escrow" or "escrow funded" may be used in the Service as a plain-language description of milestone funds pending release. Crewman is not a bank, licensed escrow company, money transmitter, trustee, or fiduciary, and a funded milestone is not a bank deposit, trust account, interest-bearing account, or insured escrow account. Payment services and the custody and movement of payment proceeds are provided through Stripe under Stripe's rules and applicable law.
C. Timing, payout, and reversals
A Service status such as "released" or "on its way" means Crewman has initiated or recorded the applicable payment instruction. Actual bank availability depends on Stripe settlement, connected-account status, banking networks, weekends, holidays, reserves, and compliance review. Payouts may be delayed, restricted, reversed, or offset as permitted by Stripe's terms, payment-network rules, these Terms, or law.
Users authorize Crewman and Stripe to process refunds, reversals, transfers, adjustments, dispute allocations, and chargeback-related actions consistent with the Service and applicable rules. A cardholder's lawful chargeback rights are separate from Crewman's internal project-dispute process. Abuse of chargebacks or payment disputes may lead to suspension, collection activity, or legal action.
Processing costs are not guaranteed to be refundable. Any refund amount and timing depend on the payment path, the applicable Project Agreement, the Service's cancellation or dispute outcome, Stripe's rules, and law.
10. Milestones, submission, release, and cancellation
Before funding, a confirmed project may be divided into milestones whose total equals the accepted project amount. A milestone generally follows this sequence:
- the Shop funds the milestone;
- the Installer starts and performs the work;
- the Installer marks the work submitted;
- the Shop approves it, proposes a downward adjustment with a written reason, or opens a dispute; and
- Stripe is instructed to transfer and, if applicable, refund the amount determined under these Terms.
The Installer must not start a milestone until the Service shows it as funded. If a Shop does not respond within seven days after submission, the milestone may automatically release in full to the Installer. If the Shop proposes a downward adjustment and the Installer does not respond within seven days, the matter may automatically escalate to a dispute; silence does not accept the reduction.
Before funding, a draft milestone may be cancelled without a payment charge. A funded but unstarted milestone may be eligible for a refund. Once work starts, the in-progress milestone must be resolved through submission, adjustment, agreement, or dispute; remaining unstarted milestones may be cancelled. The Service's displayed state and the documented project record control the platform workflow.
11. Project disputes
Either party may open a dispute over submitted work or a pending adjustment. Opening a dispute freezes the affected milestone within the platform workflow.
The dispute process generally has two stages:
- Party resolution. The parties have a five-day discussion period and may propose and accept a percentage split.
- Crewman review. If the parties do not agree, Crewman may review the Project Agreement, milestone history, messages, photos, evidence, reports, and other relevant records. Crewman may determine a platform allocation between the Shop and Installer and instruct Stripe to transfer, refund, split, delay, or reverse amounts accordingly.
Users agree to participate honestly and provide authentic evidence. Crewman's platform decision is final for purposes of the Crewman milestone workflow, subject to payment-network rules, chargeback rights, applicable law, and any legal rights that cannot be waived. Crewman does not act as a court or arbitrator, and its platform allocation does not adjudicate claims for property damage, personal injury, employment status, statutory penalties, or other relief outside the funded milestone.
Crewman may issue strikes or other account restrictions for fraud, fabricated evidence, bad-faith adjustments, harassment, or other misconduct identified during a dispute.
12. Reviews and reputation
After a completed or resolved project, each party may be asked to submit ratings, KPI responses, written feedback, and a private repeat-work signal. Reviews may remain hidden until both parties submit or the review period ends. Once revealed, a review may become immutable.
Reviews must be based on a genuine project experience and must be truthful, relevant, and not manipulated. You may not threaten, purchase, trade, fabricate, coordinate, or retaliate through reviews. Crewman may investigate, withhold, label, remove, or decline to publish content that violates these Terms or undermines review integrity.
Crewman does not guarantee that ratings or reputation information are complete, accurate, or predictive of future performance.
13. Prohibited conduct
You may not:
- violate law, another person's rights, or these Terms;
- post false, misleading, fraudulent, discriminatory, unsafe, or unlawful jobs or profile information;
- impersonate another person or misrepresent credentials, insurance, authorization, experience, or work;
- harass, threaten, exploit, discriminate against, or endanger another person;
- upload malware, infringing content, intimate content, or another person's confidential or personal information without permission;
- manipulate applications, availability, payments, reviews, reports, disputes, badges, or reputation;
- scrape, crawl, reverse engineer, disrupt, overload, or bypass the Service or its security and access controls, except where law expressly permits;
- use Crewman to facilitate illegal vehicle work, theft, fraud, money laundering, or unauthorized payment activity;
- avoid, reverse, or dispute a valid payment in bad faith; or
- help another person do any of the above.
14. Off-platform payments and non-circumvention
Users may communicate outside Crewman, but a relationship first introduced through Crewman must use Crewman's payment workflow for the original project and materially related follow-on work between the same Shop and Installer for 12 months after their first Crewman contact, unless Crewman gives written permission otherwise.
You may not solicit or accept off-platform payment to avoid the funded-milestone process, reputation system, safety controls, or an applicable Crewman fee. Off-platform work does not receive Crewman's milestone-payment, dispute, or reputation protections. Reported circumvention may result in a strike, suspension, or permanent removal.
This restriction does not prevent a user from working with a person or business with whom the user can document a genuine pre-existing relationship independent of Crewman.
15. User content
You retain ownership of content you submit, including profiles, portfolios, job posts, messages, reviews, and evidence ("User Content"). You grant Crewman a nonexclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, format, resize, back up, moderate, and otherwise process User Content only as reasonably necessary to operate, secure, support, enforce, and improve the Service and to display content according to your use of marketplace features. This license continues for retained records described in the Privacy Policy.
You represent that you own User Content or have all permissions needed to submit it and grant this license. For example, you must have permission before uploading customer vehicles, people, private premises, copyrighted media, confidential information, or evidence belonging to someone else.
Crewman may remove, restrict, preserve, or disclose User Content when reasonably necessary to enforce these Terms, protect the Service or users, comply with law, or address an intellectual-property complaint. Crewman does not promise to monitor all content.
To report alleged copyright infringement, contact imonzir07@gmail.com with identification of the work, the allegedly infringing material, your contact information, a good-faith statement, an accuracy and authority statement under penalty of perjury, and your physical or electronic signature. This contact method does not represent that Crewman has registered a statutory DMCA agent.
16. Safety, property, and insurance
Automotive customization work may involve vehicles, tools, chemicals, heat, blades, lifts, electrical systems, customer property, and workplace hazards. Shops and Installers—not Crewman—are responsible for job-site safety, legal compliance, supervision, vehicle authorization, work quality, warranties, insurance, injury, and property damage arising from the project.
Crewman does not inspect job sites, supervise work, supply safety equipment, or insure users or projects. Users should maintain appropriate commercial general liability, workers' compensation, automobile, property, professional, and other insurance as applicable. Optional profile insurance information does not create coverage or a Crewman guarantee.
17. Taxes and reporting
Each user is responsible for determining, reporting, and paying their taxes, licenses, fees, and assessments. Crewman or Stripe may collect tax information, report payments, withhold amounts, or provide tax forms when required. Receipt or nonreceipt of a tax form does not determine whether income is taxable.
Crewman does not provide tax, legal, insurance, or employment advice.
18. Reports, strikes, suspension, and termination
Users may report misconduct. Reports do not automatically establish wrongdoing; Crewman may review them and take action in its judgment based on available evidence.
Crewman may warn, strike, limit, suspend, or terminate an account for violation of these Terms, safety risk, fraud, nonpayment, legal or payment-provider requirements, repeated complaints, or conduct that threatens the marketplace. Severe cases may result in immediate suspension or removal. Strikes and administrative notes are generally private.
Suspension does not confiscate a user's lawful interest in an already funded project. Crewman may allow or require in-flight jobs, payments, disputes, and reviews to finish while restricting new marketplace activity.
You may stop using the Service at any time. Account deletion may be delayed until active jobs, disputes, and unsettled funds are resolved. Deletion and retention are described in the Privacy Policy. Sections that by their nature should survive termination—including payment obligations, dispute records, content licenses for retained records, disclaimers, liability limits, indemnity, and general legal terms—will survive.
19. Third-party services
The Service depends on third parties such as Clerk, Convex, Stripe, Expo, Apple, Google, and OpenStreetMap. Their services may be unavailable, changed, or governed by additional terms. Crewman is not responsible for third-party services outside its reasonable control.
Links to external websites, social profiles, or services do not constitute an endorsement. Your interactions with third parties are between you and the third party.
20. Crewman intellectual property
The Service, including its software, branding, design, text, graphics, and non-user content, is owned by Crewman or its licensors and protected by law. Subject to these Terms, Crewman grants you a limited, personal, revocable, nonexclusive, nontransferable license to use the Service for its intended marketplace purpose.
No right is granted to use Crewman's name, marks, or content except as necessary to use the Service or with prior written permission.
21. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." CREWMAN DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SAFETY, AND RESULTS.
CREWMAN DOES NOT WARRANT OR GUARANTEE ANY USER; JOB; APPLICATION; HIRE; PAYMENT METHOD; FUNDING, TRANSFER, OR PAYOUT TIMING; WORK QUALITY; VEHICLE OR PROPERTY CONDITION; LICENSE; INSURANCE; REVIEW; OR DISPUTE OUTCOME. YOU ASSUME THE RISKS OF ENTERING A PROJECT AGREEMENT AND INTERACTING WITH OTHER USERS, SUBJECT TO RIGHTS THAT CANNOT LAWFULLY BE WAIVED.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
22. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREWMAN AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, BUSINESS, OR REPUTATION; OR VEHICLE, PROPERTY, PERSONAL-INJURY, EMPLOYMENT, TAX, OR USER-CONTENT CLAIMS ARISING FROM ANOTHER USER OR A PROJECT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREWMAN'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE CREWMAN PLATFORM FEES YOU PAID DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.
This limitation does not limit payment amounts that the Service has finally determined should be instructed for transfer or refund, Stripe's obligations under its agreements, or liability that cannot legally be limited, including liability for Crewman's fraud, willful misconduct, or gross negligence where applicable.
23. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Crewman and its owners, officers, employees, contractors, affiliates, and agents from third-party claims, damages, losses, liabilities, judgments, penalties, and reasonable legal expenses arising from your User Content; your project, work, workplace, vehicle, personnel, taxes, classification decisions, or business; your violation of law, another person's rights, a Project Agreement, or these Terms; or your fraud, negligence, or willful misconduct.
Crewman may control the defense of a covered claim, and you agree to cooperate. You may not settle a claim in a way that admits fault by or imposes an obligation on Crewman without Crewman's written consent.
24. Disputes with Crewman; governing law
This section concerns legal disputes between you and Crewman. It is separate from the in-app project-dispute process between a Shop and Installer.
Before filing a claim, you and Crewman agree to try in good faith to resolve it informally for 30 days. Send a written notice describing the parties, facts, requested relief, and contact information to imonzir07@gmail.com with the subject Legal Dispute Notice. Crewman may send notice to the email associated with your account.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. For a claim not resolved informally, you and Crewman consent to the jurisdiction of the state or federal courts located in Virginia that otherwise have jurisdiction over the dispute. Mandatory protections of your home jurisdiction and rights that cannot be waived remain unaffected.
Nothing in these Terms prevents you from bringing an eligible individual claim in small-claims court or filing a complaint with a government agency. These Terms do not contain a mandatory arbitration agreement.
25. Electronic communications
You agree that Crewman may provide account, authentication, application, job, message, payment, payout, deadline, review, dispute, safety, legal, and policy communications electronically through the Service, push notifications, email, or another contact method you provide.
Keep your contact information current. You can disable certain push categories, but essential transactional and safety records may continue through the Service. If law requires separate consent for a particular electronic record or communication, Crewman will request that consent separately.
You may withdraw consent to optional electronic communications by contacting imonzir07@gmail.com, but withdrawal may prevent Crewman from providing account-based features. You may request a paper copy of these Terms by contacting us; reasonable printing or mailing costs may apply if permitted by law. You should retain a copy of these Terms and must have a device, internet connection, and software capable of displaying and saving standard web or PDF content.
Crewman does not currently use the supplied phone number for automated marketing texts. Any future marketing call, email, or text program will require the consent and opt-out mechanisms required by law.
26. Changes to the Service or Terms
Crewman may modify the Service and these Terms. We will update the date above and provide notice of material changes as required by law. Changes apply prospectively from their stated effective date. If you do not agree to revised Terms, you must stop using the Service.
Crewman may discontinue features or the Service, but will use reasonable efforts to address active funded milestones, payouts, and disputes before a discontinuation materially affects them.
27. General terms
These Terms and the Privacy Policy are the entire agreement between you and Crewman about the Service, except for a Project Agreement between users and any additional terms expressly presented for a feature. If a conflict exists, transaction-specific terms shown and accepted in the Service control for that transaction, followed by these Terms.
You may not assign these Terms without Crewman's written consent. Crewman may assign them in connection with a merger, acquisition, reorganization, financing, or sale of assets.
If a provision is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions remain effective. Crewman's failure to enforce a provision is not a waiver. Headings are for convenience only. The word "including" means "including without limitation."
Crewman is not liable for delay or failure caused by events beyond its reasonable control, including disasters, outages, labor disruptions, government action, payment-network failures, banking delays, or internet and infrastructure failures.
